Time to Update Two of Your Workplace Posters
June 8, 2023

The U.S. Department of Labor has issued two new posters for the workplace, and we are expecting the Equal Employment Opportunity Commission to issue an updated poster later this month. Here is what you need to know:
- One new poster contains information about new rights for nursing mothers following the enactment of the a new federal law, “Providing Urgent Maternal Protections for Nursing Mothers", or the “PUMP” Act. Information about the PUMP Act is contained in the minimum wage poster. The Department of Labor requires that you replace your old poster with the new version. You should do so as soon as possible. You may obtain the new minimum wage/PUMP Act poster here: Fair Labor Standards Act (FLSA) Minimum Wage Poster | U.S. Department of Labor (dol.gov)
- A second new poster is a redesigned version of the FMLA poster, which contains more clarity over who is a “covered employer.” You may continue to post prior versions of your FMLA poster since there are no new rights associated with the poster. However, a best practice would entail printing and posting the new FMLA poster. You may obtain the updated FMLA poster here: fmlaen.pdf (dol.gov)
- Later this month, the EEOC is expected to issue a new “Know Your Rights” poster. You should not wait for the EEOC to act before replacing your minimum wage/PUMP Act poster, however. The DOL expects you to post the new minimum wage/PUMP Act poster immediately.
