Mitch has tried many cases in both state and federal courts and has successfully defended many favorable decisions on appeal.

 

In his labor and employment practice, Mitch counsels clients through employment-related issues in an effort to avoid potential claims. His employment litigation focuses on areas such as discrimination, harassment, and retaliation under applicable state and federal laws, including the Iowa Civil Rights Act, Title VII, the ADAAA, the ADEA, and the FMLA. Mitch defends claims alleging violations of public policy, such as retaliation for asserting workers’ compensation rights, and disputes relating to employment contracts. Mitch also assists with preparing and interpreting employment contracts and separation and severance agreements.

 

Mitch’s practice includes public accommodation under state and federal law and disputes concerning the Fair Housing Act and related state and federal statutory requirements.

 

Mitch defends railroads involving claims under the Federal Employers’ Liability Act (FELA) arising out of alleged injuries suffered by railroad employees.

 

Mitch’s commercial litigation practice focuses on contract disputes involving both individuals and corporate entities often involving complex legal questions.

 

Making a niche for himself in the area of judicial review under Iowa’s administrative procedure act and Iowa Code Chapter 514J, which relates to judicial review of adverse healthcare benefit decisions, Mitch has successfully defended many claims under Iowa Code Chapter 514J at both the judicial review and appellate stages.

 

Mitch thrives on the challenges of litigation and complex legal issues. Learning each client’s business and goals drives him to work harder.

 

He appreciates those who have something different to offer to a case or his firm’s culture. “In the ever-changing landscape in which we live, diversity and inclusion are key to a company’s success,” he says. As chair of Nyemaster’s Diversity and Inclusion Committee, Mitch is always looking for ways to foster diversity and inclusion within the firm and increase the firm’s involvement in community efforts supporting such initiatives.

 

Mitch resides in Des Moines with his partner, Ben, and two children. In his spare time, Mitch enjoys being outside. He is an avid runner and cyclist. He has completed two Ironman races and innumerable triathlons and road races.
